Motion for leave to appeal decision of Canadian Radio-television and Telecommunications Commission—“Decision” contained in letter written by CRTC’s Vice-Chairman, Broadcasting in response to appellant’s complaint about structural changes being implemented by respondent—Letter not “decision” within Broadcasting Act, S.C. 1991, c. 11 s. 31(2)—No single member of CRTC, including Vice-Chairman, Broadcasting, having authority to exercise statutory powers of CRTC, including power in s. 18(3) respecting a complaint—Consideration of CRTC’s Rules of Procedure, “Fact Sheet”, lack of public access to By-Law No. 26 delegating to Broadcasting Committee exercise of CRTC’s power under s. 18(3) to hold public hearing, suggesting CRTC could improve methods of ensuring complainants understand effect of such letters, CRTC’s administrative processes, procedures for dealing with complaints, and who may make decisions in name of CRTC—Motion dismissed.
