Appeal from Federal Court decision (2005 FC 1468) Minister of Agriculture and Agri-Food, Canadian Food Inspection Agency (CFIA) having authority to consider claim for compensation under Health of Animals Act, S.C. 1990, c. 21, s. 52—Meat from 95 of respondent’s elks ordered destroyed pursuant to Act, s. 48—That section incorporated by reference into s. 54 of Meat Inspection Regulations 1990, SOR/90-288—On basis of evidence, Regulations, s. 54, open to Judge to conclude disposal of meat occurring pursuant to Act, s. 48—S. 52 of Act allowing for possible compensation to owner of “a thing that is destroyed under the Act”—As meat destroyed under Act, s. 48, Judge properly concluded s. 52 applied—Appeal dismissed.
