Application for judicial review from decision by Refugee Division applicant not Convention refugee -- Applicant national of Cuba who came to Canada on January 31, 1992 -- Feared if he returned to Cuba would be imprisoned for exceeding time allowed to remain outside country -- Division considered applicant's testimony credible but concluded problems encountered in Cuba not sufficiently serious for him to have reasonable fear of persecution -- Also considered fear of being imprisoned for exceeding time allowed for residents abroad not basis for refugee status claim -- Members of Division could have come to different conclusion, but did not act unreasonably or without regard to evidence in concluding no reasonable fear of persecution -- Problem raised by applicant essentially one of interpreting evidence -- Application dismissed.
