Application for judicial review of Immigration and Refugee Board decision rejecting applicants' claims to Convention refugee status-Male applicant excluded on basis had committed crimes against humanity during course of employment as customs officer at Khartoum airport in Sudan-Board also held female applicant did not have well-founded fear of persecution based on membership in particular social group, her family-As customs officer, applicant aware some smugglers he intercepted and referred to police were beaten, and, in one case, executed, but did nothing out of fear of being investigated and exposed as member of persecuted political party-Board erred in failing to determine whether impugned activities of police constituted crimes against humanity-Board should have considered, as indicated in Sivakumar v. Canada (Minister of Employment and Immigration), [1994] 1 F.C. 433 (C.A.), whether victims of police abuse members of group targeted systematically and in widespread manner for one of crimes mentioned-Application allowed.
